May 21: Preparing for a Meet and Confer Session

Litigation today requires that substantial amounts of electronic information be exchanged between the parties. Early on, the litigants must get together for a Meet and Confer session. There, they decide what electronic information will be exchanged between the parties, and according to what schedule. It is important to be well prepared for the Meet and Confer session. Topics include: What should be in the systems map, what type of information is likely to be considered excessively burdensome to produce, what questions should be asked to determine relevant information, reducing the costs of production and how the FRCP are likely to vary at the local level.
